3. User Accounts and Registration

3.1 Account Creation

To access certain features of our platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Protect your account credentials and maintain their confidentiality
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Types

We offer different types of accounts with varying privileges:

• Regular Users: Can search properties, save favorites, and make inquiries
• Agents: Can list properties, manage bookings, and access analytics
• Agency Administrators: Can manage multiple agents and properties
• Property Owners: Can list properties and manage bookings

3.3 Professional Verification

Agents and agencies must provide valid credentials and undergo verification. We reserve the right to suspend or terminate accounts that fail verification or provide false information.

4. Property Listings

4.1 Listing Requirements

When listing a property, you must:

• Provide accurate and truthful information
• Include clear, recent photographs
• Set fair and competitive pricing
• Comply with local real estate laws and regulations
• Have proper authorization to list the property

4.2 Prohibited Listings

You may not list properties that:

• You do not have authorization to list
• Contain false or misleading information
• Violate local laws or regulations
• Include discriminatory language or practices
• Are duplicate listings without authorization

4.3 Listing Fees and Commissions

Listing fees and commission structures are outlined in our pricing plans. By listing a property, you agree to pay applicable fees and commissions as specified in your subscription plan.

5. Bookings and Payments

5.1 Booking Process

When making a booking through our platform:

• You agree to pay all applicable fees and charges
• Bookings are subject to property owner approval
• Cancellation policies vary by property and are clearly stated
• Payment is processed through our secure payment partners

5.2 Payment Methods

We accept payments through the following methods:

• M-Pesa (Kenya and Uganda)
• MTN Mobile Money
• Airtel Money
• Bank Transfer
• PayPal
• Wise (formerly TransferWise)
• PesaPal
• Pay at Gate (where applicable)

5.3 Currency and Pricing

We support multiple currencies including KES, UGX, USD, EUR, and GBP. Prices are displayed in your selected currency, and exchange rates are updated regularly.

5.4 Refund Policy

Refunds are processed according to our Refund Policy. Refund eligibility depends on the property's cancellation policy and the timing of your cancellation request.

6. User Conduct and Responsibilities

6.1 Acceptable Use

You agree to use our platform responsibly and not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Upload malicious software or harmful content
• Engage in fraudulent or deceptive practices
• Harass, abuse, or threaten other users
• Attempt to gain unauthorized access to our systems
• Use automated tools to scrape or harvest data

6.2 Content Guidelines

All content you post must be:

• Accurate and truthful
• Respectful and professional
• Free from discriminatory language
• Compliant with copyright laws
• Appropriate for all audiences

6.3 Communication Standards

When communicating through our platform, you must:

7. Subscription Services

7.1 Subscription Plans

7.2 Billing and Renewal

• Subscriptions are billed in advance on a recurring basis
• Auto-renewal can be disabled in your account settings
• Price changes will be communicated with 30 days' notice
• Failed payments may result in service suspension

7.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months except as required by law.

8. Intellectual Property Rights

8.1 Our Rights

All content on our platform, including text, graphics, logos, images, software, and other materials, is owned by or licensed to Ojjo Real Estate and is protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

By posting content on our platform, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, display, and distribute your content for the purpose of providing our services.

8.3 Copyright Infringement

We respect intellectual property rights and will respond to valid copyright infringement notices. If you believe your copyright has been infringed, please contact us with detailed information about the alleged infringement.

9. Third-Party Services

Our platform integrates with various third-party services including:

• Payment processors and financial institutions

Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the actions or policies of third-party service providers.

11. Disclaimers and Limitations of Liability

We do not verify all information posted by users. Property listings and other user-generated content are provided by third parties, and we make no representations about their accuracy or completeness.

11.3 Limitation of Liability

To the maximum extent permitted by law, Ojjo Real Estate shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.

11.4 Warranty Disclaimer

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ojjo Real Estate, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post on our platform
• Your property listings or transactions

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting our support team or using the account deletion feature in your profile settings.

13.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activities
• Fail to pay required fees
• Abuse our platform or other users
• Provide false information during registration

13.3 Effect of Termination

Upon termination, your access to our services will cease, and we may delete your account and associated data in accordance with our data retention policies.

14. Dispute Resolution

14.1 Negotiation

If a dispute arises, we encourage you to contact us first to try to resolve the issue informally.

14.2 Mediation

If informal resolution is unsuccessful, disputes may be resolved through mediation before proceeding to formal legal action.

14.3 Governing Law

These Terms are governed by the laws of Uganda. Any legal proceedings must be brought in the courts of Kampala, Uganda.

14.4 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

15. Mobile Applications

Our mobile applications are subject to additional terms:

• Apps are distributed through third-party app stores subject to their terms
• Updates may be required for continued functionality
• Device permissions should be granted only as needed
• App usage data may be collected for improvement purposes

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Ojjo Real Estate.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16.3 Assignment

We may assign these Terms or our rights and obligations without notice. You may not assign your rights or obligations without our written consent.

16.4 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
